By visiting the Website, placing an Order, or accepting delivery of Products, you confirm that you have read, understood, and agreed to be bound by these Terms.

1.3. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the Courts of Kenya situated in Kiambu County or Nairobi County, as applicable.

We strive to ensure all product information is accurate. However, the final specifications of delivered equipment may vary slightly due to manufacturer updates. We reserve the right to correct any errors, inaccuracies, or omissions.

We warrant that all Medical Devices sold on this Website are sourced from manufacturers and suppliers who comply with the regulatory requirements of the Pharmacy and Poisons Board (PPB) and the Kenya Bureau of Standards (KEBS) as required by the relevant Kenyan legislation.

3.1. Pricing and Tax

All prices are quoted in Kenyan Shillings (KES) and are inclusive of Value Added Tax (VAT) and all other applicable Kenyan statutory taxes, unless explicitly specified otherwise (e.g., for certain bulk institutional orders).

3.2. Order Confirmation

An Order placed by You constitutes an offer to purchase the Products. The Order is only deemed accepted when we send You an email Order Confirmation. We reserve the right to decline any Order due to Product unavailability, errors in pricing, or suspected non-compliance.

3.3. Payment

Full payment is required before dispatch. We accept payment via M-Pesa, bank transfer, and major credit/debit cards as listed on the Website. Payment security is managed through accredited local payment gateways.

4.1. Delivery Area

Delivery services are provided throughout the Republic of Kenya. Delivery to remote areas may incur additional surcharges or extended timelines, which will be communicated before dispatch.

4.2. Delivery Times

Delivery dates are estimates only. We are not liable for delays caused by third-party couriers, force majeure events, or customs delays affecting imported stock.

4.3. Transfer of Risk

The risk of loss or damage to the Products shall pass to the Buyer upon the Buyer's or the Buyer's designated agent's physical collection or documented receipt of the Products at the specified delivery address.

4.4. Inspection on Receipt

You must inspect all Products immediately upon receipt. Any claims regarding shortages or transit damage must be reported to the courier and Us within forty-eight (48) hours of delivery.

5.1. Returns Policy (Change of Mind)

Returns for non-defective items are accepted within seven (7) calendar days of delivery, provided the Products are in their original, sealed, unused, and resalable condition. Such returns may be subject to a standard restocking fee (e.g., 10%) to cover handling and quality assurance checks.

5.2. Non-Returnable Items

For public health and hygiene reasons, Products that are sterile, disposable, custom-ordered, or whose tamper-proof seals have been opened are strictly non-returnable.

5.3. Warranty

Product warranties are provided by the original manufacturer. We act as an authorized distributor and commit to facilitating valid warranty claims for durable equipment in accordance with the manufacturer's official policy (typically 12 months for major equipment).

5.4. Refunds

Approved refunds will be processed within 10 working days and returned via the original payment method, M-Pesa, or bank transfer, as appropriate.

6.1. Exclusion of Consequential Loss

To the maximum extent permitted by Kenyan law, We, Our directors, employees, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages (including, but not limited to, loss of profits, downtime, or business interruption) arising out of or in connection with Your purchase or use of the Products.

6.2. Maximum Liability

Our total cumulative liability to You for any and all claims arising under these Terms shall not exceed the total price paid by You for the specific Product(s) giving rise to the claim.

7.1. Ownership

All content on the Website, including the company logo, product images, and documentation, is the exclusive property of Reliable Medical Equipment Kenya Limited or its licensors and is protected by Kenyan and international intellectual property laws.
